How annual leave works under Kuwait Labor Law

Article 70 of Kuwait Labor Law (Law No. 6 of 2010) gives every private-sector employee 30 days of paid annual leave per year of service. Leave accrues pro-rata: every day worked earns a fraction of the 30 days, starting from the first day of employment.

An employee can take their first annual leave after 9 months of continuous service with the employer. The 9-month rule only delays when leave can first be taken — it does not reduce what is earned.

Fridays (the weekly rest day) and official public holidays that fall inside a leave period are not counted against the annual balance. Unused leave can be accumulated for up to two years with the employer’s approval, and leave pay is due in advance, before the leave starts.

Worked example

An employee hired on 1 March 2025 has been in service 300 days by 26 December 2025, including 10 days of unpaid leave. Days earning leave: 290. Entitlement: 290 ÷ 365 × 30 = 23.8 days. They passed 9 months of service on 1 December 2025, so leave can now be taken.

Sick leave is separate — and tiered

Article 69 gives employees up to 75 days of sick leave per year, with a medical certificate, paid on a sliding scale. Sick leave never comes out of the annual leave balance:
